1.CONFIRMATIONS OF ORDER AND ACCEPTANCE :

The sale of our products is governed exclusive by these general conditions; any modifications, amendments, exceptions and/or cancellations must be agreed upon exclusively in writing and must be expressly accepted by Spareage®. In particular, in the event of Spareage® receiving any requests for cancellations following the start-up of production the seller reserves the right to refuse or accept them subject to partial payment of the supply depending on the stale of progress of the production itself. Particulars conditions (amounts, price, methods of payment etc.) of individual orders will be those indicated in the individual offers sent by Spareage® orders will only be accepted if they comply with the offers. These general sales conditions are shown on the back of each and order confirmation sent by Spareage® SR I and constitute an integral and essential part of same: likewise they are posted on the seller's website (www.Spareage®.in) in compliance with the offer made by Spareage®, the order even in the event of not-being signed, foresees acknowledgment and acceptance of these general conditions . Furthermore, these general sales conditions, will prevail over any other condition or agreement indicated by the Client. we will regularly inform our customers about any price modification via email or by quotation. and same will be update on the website.

2. TERMS OF PAYMENT AND OVERDUE PAYMENTS:

The prices and methods of payment arc those shown in the offers issued by Spareage® and, if issued by representatives and/or distributions are only binding following confirmation and acceptance by the seller. Default or overdue payment of the amount by the due date agreed upon in the order, will entitle Spareage® to claim overdue interest on the amounts owed and not paid at the rate determined in accordance with Legislatives Decree No.232 of 9 October 2002, starting from expiry of the due date agreed upon. a) Interest @18% per annum will be changed if payment is not made on due date. b) All disputes will be settled subject to Mumbai Jurisdiction only.

3. GUARANTEE:

Apart from cases of exclusion for all liability as stipulated in point (8) above Spareage® warrants that it will assume responsibility for any faults and /or defects in the products sold and will undertake to replace same at no additional cost or, at the seller's request to reimburse the price paid subject to return of the goods. No compensation will be offered by the seller for any possible direct damage to wither the client's system or end product. This guarantee will only be valid on condition that: a) The client sends written notification, within the 8 days deadline stipulated from the date of delivery, detailing any obvious or evident faults and/or defects. b) The client sends written notifications, within the 30 days deadline stipulated following discovery, detailing faults and/or defects that were not immediately evident or only evident following their use and in case not later than one year after delivery. c) That the client has provided suitable and sufficient "Technical Specifications'', with respect to which the product conforms regardless of the final application of the product. d) That the client has used the product in accordance with the instructions and technical methods specified.

4. Refund, Return & Cancellation policy:

We will refund you the full amount or provide free of cost replacement of the product within Seven (7) days after the product has been delivered, in case you have; changed your mind to buy the item(s) you have ordered or;received item(s) in poor, damaged or mutilated condition or; received an item(s) that is different from the item(s) that you have ordered with us; In order to get full refund, please return the item(s) to us in their original packing in unopened and undamaged condition, with all original tags/labels attached along with proof of purchase within Seven (7) days from date of receipt of items(s) at your end. All costs associated with returning the item to us including return shipping charges and any taxes if applicable shall need to be taken care by you. Gift cards, personalised products, sale, clearance and promotional items are not eligible for a return or exchange. Original shipping cost will deducted from the refund amount. If you wish to cancel an order that has been shipped but has not yet been delivered, please get in touch with our sales/support team and inform them at the earliest possible. In case you have cancelled an order, which has already been handed over to the courier company from our end, they will still attempt delivery. Kindly do not accept the delivery of the order. Once we receive the product(s) back and verify its packaging/condition, we will initiate refund procedure for your money within 3-4 working days. The refund will be processed to the same account/method from which the payment was made. It may take 2-3 additional business days for the amount to reflect in your account.

5. JURISDICTION:

Any controversy, claim or dispute arising between parties in connection with the interpretation and fulfillment of this sales contract will be referred to the exclusive jurisdiction of the courts of Mumbai. This sales contact is likewise exclusively governed by Indian Law.
